It became known that the Capital Construction Department held a competition for the reconstruction of the oncology clinic with violations. The republican budget was missing more than 120 million rubles. How did you manage to pull off such a deal?
— Do you know from what year the reconstruction of our oncology clinic has been going on? Since 2014. Then only the design and estimate documentation was prepared, and the builders appeared here in 2021. And it was their appearance that became the subject of interest of the supervisory authorities, especially the Federal Antimonopoly Service. But first things first.
— The Capital Construction Department, its head then was Viktor Guslyakov, is holding a competition to identify a contractor in 2021. The contract value is 773 million rubles. Four companies volunteered to earn money. But we are only interested in two – “Stroyinkom” and “Buryatproektrestavratsiya”. The latter offered 738 million - the amount for which they are ready to complete all the work. But their competitors from Stroyinkom offered a much lower price, 122 million rubles. It would seem that such savings are a great success for the republican budget. But for some reason they give the contract to Buryatproektrestavratsiya.

By the decision of the Buryat OFAS commission, violations were identified in the customer’s actions during this purchase and, as the Buryat OFAS commission considered, the winner was incorrectly determined.
— So, as you may have guessed, Stroinkom complains to the Federal Antimonopoly Service and they side with the entrepreneur. We sorted it out quickly, the order was to cancel the results of the competition and do it all over again. Well, report on the work done. Then something very similar to a special operation begins.
The competition is taking place on an electronic platform, so on September 9, 2019, she will simply be banned. It is impossible to conclude a contract or transfer money to the winner; the buttons cannot be pressed. Three days later, on September 12, the ban was lifted for only 40 minutes, and then the site was blocked again.
But this time was enough for the Capital Construction Department to sign a contract and transfer the advance payment to the winning Buryatproektrestavratsiya. This is not a glitch at all; the blocking can only be removed using the electronic digital key of a FAS employee. The competent authorities are currently working with this employee.

If we see that there is a prohibition, and we understand that there is an order, there is a requirement. And somehow this ban is lifted from the site. Yes, the opportunity to conclude a contract has arisen. But still, everyone understands perfectly well, everyone knows the law - this cannot be done, the contract could not be concluded.
- So, let's secure it again. The Federal Antimonopoly Service issued an order to hold the competition again, but UKS still concludes a contract with Buryatproektrestavratsiya. Antimonopoly activists go to court, which lasts almost a year with all appeals. During this time, the heads of both the Buryat OFAS have time to change - now it is Viktor Gribko, and the Capital Construction Department - now it is Anatoly Urbanov. As a result, in this legal battle, victory remains with the antimonopoly authorities. The deal was declared invalid in court. However, time has already been lost - the contractor managed to start work, report for some of the work completed and receive an impressive portion of the money.
— Am I correct in saying that the deal was declared invalid?

— Invalid, but the money, some part of the money, has already been transferred to the contractor, do I understand correctly?

Well, we paid for the work actually completed. That is, the contract is valid, the work was carried out, the work was completed. We paid about 630 million.
— The contract, as I understand it, was terminated? Part of the work performed was paid for. Of this amount, about 100-odd remains, right?

As the OFAS explained to us, at the trial the position of the UKS was as follows: “We do not agree with your decision to cancel the competition and consider such a decision to be futile.” One way or another, the money, in fact, cannot be returned. Now the scandalous oncology dispensary is being completed and is promised to be completed by the end of this month.

Well, first of all, we had a story with medical equipment. Initially, there was a very serious situation with non-delivery, and Viktor Guslyakov was brought to criminal liability. Here we are talking about 740 million rubles. In fact, this is what these documents say - the investigator directly writes here that a contract was illegally concluded and acts of acceptance of construction work were signed, which in fact did not exist at that time. Money was transferred, the deal was concluded with the most terrible violations. Now, in fact, only 10-15% of the work was completed, that is, again, this is official fraud, there are a lot of criminal articles here.
Viktor Guslyakov was held responsible only for the strange story with medical equipment for the dispensary. He managed to sign documents on its acceptance, although the equipment itself had not yet arrived at that time. For official forgery, the official got off with a fine of 40 thousand rubles. According to the story of the construction competition, a criminal case was not opened even after several attempts.
- Two contracts - there’s a scandal with medical equipment, there’s a scandal here. Is this a coincidence or is it some kind of connection that leads to some kind of vicious system?

Well, I wouldn't say it's a coincidence. From what we see, I, as the head of the supervisory authority, do not believe in such coincidences. It is quite possible that some kind of chain, some kind of system has been built. But again, I will repeat that we considered only one purchase, so there can only be assumptions here.

Firstly, the UKS appears everywhere here. Everywhere the same key persons appear who signed documents, committed official forgery, and entered into illegal contracts. They transferred our public money, our taxpayers, into unknown pockets, it is unclear whose.
— What role did the Ministry of Construction play in this whole story?

The Ministry of Construction is the founder of UKS. What does founder mean? This means the owner of this UKS. He established it and he is responsible.

Of course, this is the leader, that is, the minister is the leader of this Guslyakov.

It would be more expedient for me, well, as a customer, let’s assume that this was one large purchase. So that I have one counterparty who would hand over all this to me on a turnkey basis. And here the question arises: why was it necessary to split this purchase into two? Well, maybe not split, maybe it was originally intended that there would be two of them, but it could be combined. But then our contract amount would be about 1.5 billion rubles. If 1.5 billion rubles, then if a complaint was received about the customer’s actions during this purchase, the complaint should have been considered by the Central Office of the FAS Russia in Moscow. Here we can only speculate why they crashed. Maybe they assumed that somewhere it would be easier to evade responsibility.
“Couldn’t it be possible to play these two contracts into one, so that one contractor would do this?” It is impossible for all this to be done and the supply of medical equipment. Well, we mean that one contractor will provide you with a turnkey project.

This would be great, of course, but Law 44 is unambiguous. And it directly prohibits the simultaneous procurement of equipment and construction and installation work. Well, this is in order to make competition more expanded.

We also made a decision in which we recognized that an agreement had been reached between the customer and Buryatproektrestavratsiya. This decision is now being appealed in court. And the fine there is very large and is calculated based on the contract amount.
— Do I understand correctly, this is about a conspiracy?

This is a matter of conspiracy in the sense that the order was not fulfilled and the contract was concluded. The customer suggests to the participant: “Let’s conclude a contract.” But if this is a conscientious participant, he, of course, will say: “Yes, no, what are you talking about. We have such a decision, an order, a requirement on the site. It is forbidden". But, nevertheless, they conclude a contract and begin to fulfill it.
— Why is the dispensary still not ready?

In 14, work began on the construction of the building itself. Then funding stopped and construction was mothballed. And in 2021, funds finally appeared. Well, you understand, after four years, design documentation becomes outdated, as some new standards are introduced.

Well, we must take into account that this is, after all, a medical center, and the requirements for it are much stricter and greater compared to the same sports complexes, the same schools. I hope that we should complete the project this spring.

It is allowed to use any anti-inflammatory or antiseptic eye drops available in your home medicine cabinet. However, it should be understood that self-medication is dangerous, and if after a single use the symptoms do not disappear, consultation with an ophthalmologist is required.
What if your partner has sexually transmitted diseases?
There is a chance of contracting sexually transmitted diseases. After all, sperm is non-sterile and carries millions of pathogenic microorganisms. When in contact with the vaginal environment, a woman can become ill with HIV, syphilis, gonorrhea, chlamydia and other diseases.
